DRAFT Minutes of a Meeting of the Tintagel Parish Council

held on Wednesday 3rd March 2010

Present: Cllrs. Flower, Wickett, Dangar, Hodge, Dorman, Heath, Dyer, Smith & Dray

Apologies: Cllr. Menhenick

18 members of the public were present

Invitation to members of the public to speak prior to meeting regarding items on the Agenda (10 minutes allowed for this item)

Mr. David Flower spoke about the problems with surfacing to Bowithick Hill and shared photos of particularly bad areas of surfacing which have been in existence for many years. He has been in contact with Cornwall Council’s Solicitor who has advised him that at the last inspection on 21.9.09 no actionable defects were noted. The Chairman advised that the Parish Council have written to Cornwall Council many times about surfacing/pothole problems in the Parish. It was agreed that the Clerk should once again write to Cornwall Council regarding this issue.

The proprietor of the new Fresh and Local advised that his shop will be the site for Post Office services from 19.4.10. He is awaiting a response as to whether a transport service can be provided to a neighbouring post office during the period of closure from 1.4.10 - 18.4.10. The Clerk had received correspondence from the Post Office confirming the period of closure and also that vehicle licensing would not be able to be carried out. This was different information to that received by the proprietor.

A gentleman spoke about the problem of dog fouling at Trebarwith whereby many holidaying families bring their vehicles down to the top of the gully to unload, thereby letting their dogs run on down to the beach with many fouling in the gully. He felt more dog waste bins should be provided both in Trebarwith and on Glebe Cliff.

Ian Kemp, National Trust attended and agreed that the National Trust would be happy to provide more bins on Glebe Cliff.

Chris Jarvis spoke on behalf of Forrabury and Minster Parish Council and as a resident of Trevalga regarding the application to vary the noise levels on Condition 15 of the planning approval for the sewage treatment works. South West Water have advised that the application has arisen from an error made by the Planning Department but Cornwall Council have advised that no error was made. He had asked many questions at the recent Liaison Group meeting which had remained unanswered.

The Clerk read out short emails from both Trevalga and Forrabury & Minster Parish Councils advising that they intended to object to the revised Condition 15 of the Planning Consent.

Cornwall Council Dog Warden - Mr. R. Downing attended the meeting at the request of the Parish Council.

Richard advised that during the winter period he is the only Dog Warden employed by Cornwall Council to cover the whole of the ex-NCDC area. In the summer a further Warden is employed but the beaches from which dogs are banned have to be patrolled on a regular basis during this time. He is also responsible for investigating complaints of barking and stray dogs, therefore patrols to identify dog fouling problems are limited. He stressed that anyone who sees an offender must report them to either his office, the local PCSO or the Parish Clerk. Reports can be given anonymously in which case only a written warning can be sent or if you wish to give your name, a Fixed Penalty can be issued even leading to Court.

Cllr. Dangar felt there was a problem with Trevena Square where people often let their dogs off the lead to run down through the nature area and foul. If anyone witnesses this they are urged to report the offenders. The fixed penalty is £80 reduced to £50 if paid within 7 days.

He updated on the new The Fouling of Land by Dogs (Cornwall) Order 01/201 which basically states that offences can be committed on "all land which is open to the air and to which the public are entitled or permitted to have access, with or without pavement, within the County of Cornwall other than land which is placed at the disposal of the Forestry Commissioners".

The Chairman opened the meeting at 7.35 p.m.

Minutes of the previous meeting 3rd February 2010 and Matters Arising

The Clerk advised that a site meeting was to be held at the proposed site of the development in Molesworth Street on Tuesday 9th March. The Chairman would attend.

The letter from Cornwall Council regarding highway repairs reported to this meeting was mentioned and as previously agreed the Clerk would write to Cornwall Council again.

It is was proposed by Cllr. Dorman and seconded by Cllr. Dyer that the Minutes be signed as a true record of the meeting. All in favour.

REPORTS

Police Geoff Squires attended the meeting and reported one domestic crime in Tintagel within the past month. A member of the public asked about whether road traffic accidents are reported to Cornwall Council by the Police and it was confirmed they were.

CCC C/Cllr. Brown had nothing to report other than the date of the site meeting next week at Molesworth Street. He also mentioned the letter later on the Agenda regarding car park charges.

Cllr. Flower asked Cllr. Brown about highway repairs. Cllr Brown advised that he understood a deeper coating was put on the recent patching works to Bowithick Hill.

Cllr. Dyer asked Cllr. Brown to defend the proposed closure of the library at Camelford and urged him to fight to keep it open.

Trevalga Construction Liaison Group meeting Clerk/Cllrs. Hodge & Wickett

  • Copy correspondence from Nicholas Pearson Associates re: Planning Conditions 2, 5, 13 & 16

Cllr. Hodge updated members on the proposed changes to the above planning conditions. The Parish Council had not yet received consultation from Cornwall Council on this issue. Cllr. Dangar felt the building at Castle Road should be stone faced and asked that this be raised at the next Liaison Group meeting.

  • Cornwall Council - Consultation re: Variation of condition 15 (Noise (Operation))

Cllr. Hodge gave an outline of what these changes meant. He had asked many questions at a recent meeting with SWW about attenuation, frequencies and how and where measurements were made none of which he considered were answered satisfactorily. He proposed that Tintagel Parish Council object to the application and that South West Water be made to adhere to the limits previously set under Condition 15. He had asked the question of SWW at a recent meeting that if the application was turned down by Cornwall Council could the limits set out in the existing condition be achieved and neither a yes or no answer was given.

Cllr. Wickett had been unable to attend the last Liaison Group meeting but was not reassured by South West Water that incorrect levels were set. These noise levels affected people of the parish, residents of Trethevy and those living near the pumping stations in Back Lane and Castle Road. He also felt that the Parish council should object to this application.

Cllr. Heath had copies of the Cornwall Council Planning Policy Guidelines 24 containing advice and guidance from the World Health Organisation of levels of 55 decibels during the day and 35 decibels at night. He asked Cllr. Brown if he would back parishioners in objecting to this application but Cllr. Brown advised he had received no information at present to enable him to decide on this issue nor had he received any phone calls about this. Cllr. Flower asked for a show of hands and all those present, both councillors and members of the public objected to the application. Cllr. Heath stated that as Cllr. Brown had been voted by the public he should support them. Cllr. Hodge felt that after 16 months of discussion between Cornwall Council and South West Water on this issue the information should be readily available to Cllr. Brown. Cllr. Hodge also felt that Cllr. Brown should not vote on this issue due to personal circumstances.

The Clerk read out two emails from Trevalga and Forrabury and Minster Parish Councils advising that they were objecting to the application.

It was proposed by Cllr. Heath and seconded by Cllr. Hodge that the Parish Council object to this application. All in favour.

The Clerk had received a response from South West Water about the speed of the blue tractor being used to carry out work.

Cllr. Wickett had received complaints about muddy footpaths in the parish - path at bottom of Back Lane and the path from Gavercombe Farm across golf links. Clerk to report these issues to Cornwall Council (Chris Monk).

Camelford Community Network Meeting - Clerk & Cllrs. Flower, Hodge, Heath & Dyer

The Clerk outlined the purpose of the first meeting attended by the above Councillors. It was agreed that members should think about the three top Local Operational Issue priorities for their parish which had been requested at the Network Meeting. Councillors to think about any issues prior to the next meeting.

Cllr. Dangar felt that the issues raised on the Draft Local Operational Issues list were mainly Camelford based and the Clerk stressed that unless the Parish Council raised issues to be considered for the list they would obviously not form part of it. Issues to be taken to the next meeting of the Network Group would be discussed at the next meeting.

Christmas Lighting Committee - Cllr. Smith and Clerk

The Clerk read out an email received from Mrs. Goldsmith following the Christmas Lighting Committee meeting. Councillors were sorry to hear of her feelings and decision to have no further part in the Committee and it was agreed to write and thank her for all her hard work over the last 4 years.

The Clerk and Cllr. Smith gave a short report on the meeting and the formation of an enlarged Committee and it was hoped that with the help of more Committee members the Christmas and fund raising events could become even more successful.

AGENDA ITEMS

Tintagel Parish Plan

  • Newsletter The Clerk had produced the first small newsletter which had received some good comments and seemed to be well received. She intends to produce a second newsletter by the end of March to be published hopefully on 1.4.10 before the Easter weekend.

  • Dog Fouling

For information - Cornwall Council - The Fouling of Land by Dogs (Cornwall) Order 01/201 and "The Dogs on Leads by Direction (Cornwall) Order 01/02010 Notices and Map

This had been discussed with the Dog Warden earlier in the meeting.

  • Letter from Mrs. V. Stephens - Speeding traffic through Trewarmett

A letter and petition had been received from Mrs. Stephens and residents of Trewarmett asking for the speed limit to be reduced through Trewarmett. It was agreed to send a letter of support to Cornwall Council. It was also agreed that possibly at the June meeting of the Parish Council, the Police and representatives from the Highways Department be invited to the meeting in order to discuss such speeding and road safety issues along with those raised on the Parish Plan.

Trevena Square

  • inclusion in Cornwall Council Parking Places Order - nothing further to report at this meeting but it was noted that the Parking Places Order would be in force before the next meeting of the Parish Council.

  • Public Conveniences Cllr. Hodge felt that the doors to the conveniences needed painting. The Clerk would raise this issue with Cornwall Council. The lights in the seats were still not working. Clerk to try and resolve this.

Tintagel Social Hall Management Committee - Annual Accounts

Copies of the accounts were distributed and noted.

Ancient stone in front of the Wharncliffe

Cllr. Dyer felt the stone should be moved to a more suitable location. The Clerk would look out the paperwork from when this issue was raised at the time of the Regeneration Scheme and bring to the next meeting.

Hanging Baskets

The Clerk had received advice from Cornwall Council gardeners in the St. Ives area about suitable plants and had been given names via the Garden Club of additional nurseries to request quotes from. After discussion it was agreed that the Parish Council handyman should maintain the baskets this year and Cllr. Heath agreed to get details and prices of a tank/pump that could be used to water the baskets. Clerk to get quotes for filling of baskets.

CORRESPONDENCE

Mobile hot food shop, Sword in the Stone Car Park

The Clerk had received a complaint about the siting of the above and had contacted Cornwall Council. She had been advised that there were no hygiene issues and did not appear to be any particular planning issues.

Post Office - letter re: temporary branch closure

Noted and discussed previously.

Letter from Mrs. J. Bull re: position of Parish Councillor

The Clerk had taken advice from Cornwall Council and the Parish could either place a further advert for co-option now or in the future. It was agreed that the Clerk would place a further advert for Co-option of a Parish Councillor in the notice boards by the end of the week.

Cornwall Council - Car Park Charges questionnaire

Cllr. Dangar declared an interest in this matter. Cllr. Flower agreed to complete the questionnaire.

ACCOUNTS PAYABLE

It was proposed by Cllr. Dyer and seconded by Cllr. Dorman that the cheques be signed. All in favour.

DATE AND TIME OF NEXT MEETING

The next meeting would be held on 7th April. The AGM of the Parish Council would be held on the 5th May with the Annual Public Parish Meeting to be held on the 12th May, with Trevena Square being the main issue to be discussed on the Agenda.

There being no further business, the Chairman closed the meeting at 9.10 p.m.

          The Great Seal Hunt

The Royal SealWe never thought we would be hunting seals in Tintagel but we are!

The ancient seal of the Borough has disappeared. This seal was last heard of in the possession of Mrs. Symons of Bossiney about 100 years ago. The seal was used to impress sealing wax on to documents and the mark was as shown. The handle consists of two acorns and oak leaves.                            To see a copy of the actual charter look in 'Royal Charter'.           

 Has anyone seen the seal?

The inscription of the Seal reads 'SIGILLVM MAIORIS ET BVRGIENSIV BVRGI DE TINTAIOEL'.   
(The sacred symbol of the Mayor and Burgesses of the Borough of Tintagel)
